News: Strata Management Tribunal Cannot Process Complaints About Haunted Houses

The Strata Management Tribunal (SMT) was able to address most claims it had received, according to the Ministry of Housing and Local Government (KPKT), reported The Edge.

“We have received 4,390 registered cases last year and we have resolved 3,879 cases,” the Ministry and SMT’s Senior Legal Officer Roshan Karthi Kayan.

He noted that most of the claims filed to the tribunal involved inter-floor leakage and maintenance fee collection, but he declined to divulge the exact statistics.

Roshan revealed this after sharing the common issues for strata property owners at the Property Management Time Bomb Seminar 2018 that was jointly organised by Malaysia Shopping Malls Association (PPK) and FIABCI Malaysian Chapter.

On the other hand, all 2,082 cases submitted to the Tribunal for Homebuyer Claims have been settled.

He said homebuyers who submitted complaints to both tribunals will be provided with a hearing date on the spot. But the largest issue in the process lies in claims submission.

Roshan explained that the tribunals cannot act on claims if it’s unclear or unreasonable. For example, those related to ghosts, barking dogs and a home’s poor condition.

“To solve your case efficiently, you have to state your claim clearly, precisely and accurately with sufficient facts and evidence,” he added.
